SAVE St. Mary Cemetery – Activists hope to prevent destruction of local cemetery

SAVE St. Mary Cemetery Rally – Saturday, September 1, 2012:

Save St. Mary Cemetery:
Over 5 months ago, on March 24, 2012, it was discovered that Creek Land & Cattle Company, a land development business registered in the State of Nevada, had encroached upon the old St. Mary Cemetery located on Hughes Cemetery Road between Italy and Avalon, Texas. They removed a fence on the west and north sides, as well as a portion of fence on the south side and bulldozed a road through a portion of the burial ground. Texas Cemetery Laws prohibit this type of activity. The intrusion upon, as well as the damage to St. Mary Cemetery was immediately reported to Ellis County law enforcement officials. A few weeks ago holes were dug into the gravesite to accommodate concrete for a newly constructed fence established so as not to interfere with the illegal road.

County law enforcement officials have, so far, failed to issue any type of injunction to stop Creek Land & Cattle Company from doing as they please at St. Mary Cemetery. The developer continues to use the road to transport trucks and heavy excavation equipment over the gravesite and the construction of the fence indicates that he plans to continue in blatant disregard of the laws of the State of Texas.

Local activist Elmerine Bell is asking all of us to Help us SAVE ST. MARY CEMETERY, an old graveyard which dates back to the 1870s and contains the remains of individuals who were vital in the transformation of this part of Ellis County.

A rally of family, neighbors, friends, historians, and cemetery preservationists from across the state was held on Saturday, September 1, 2012 at 12:00 noon in front of the cemetery on Hughes Cemetery Road. Bell, who has been tracking and taking on the problem for several months, has a basic message she is trying to promote, “Together we can save St. Mary Cemetery from the same plight of hundreds of other cemeteries that are destroyed each year by encroaching land developers who have no regard for the sanctity of the dead and from law enforcement officials who choose to look the other way.”

The Save St. Mary Cemetery Rally lasted about one hour at which time local activist Elmerine Allen Bell used a megaphone to explain to those attending about the misfortunes St. Mary Cemetery has been enduring at the hands of the Creek Land & Cattle Company while the local law enforcement continues to turn a blind eye. Bell hoped the rally would allow people to see just what has occurred at the cemetery and make a personal analysis of the situation.

Bell was able to point out how a fence line has been ripped out and an less-desirable chain-link fence was erected in a different location, surrounding what is left of the disturbed gravesite. Dangling tree limbs and vines offer residual proof that earth moving equipment had already cleared away 1/3 of the cemetery.

“A bulldozer was used to tear down the existing fence and remove trees and undergrowth, all the while, destroying burial plots and disrupting what was meant to be the final resting place of our ancestors. There is still a marker dating back to 1879 but who knows for sure what’s been lost forever due to the greed displayed by the Creek Land & Cattle Company,” explained a disappointed but highly motivated Bell. “This is my mission now. I’m dedicating myself to seeing this through and protecting those remaining burial sites here at St. Mary,” explained a spirited Bell.

Bell invited guests to register and then take a moment to walk the property and view the aftermath and areas of the cemetery still very much in jeopardy. Basically, St. Mary Cemetery is divided into three parts, the Black section, the Mexican section and the White section. As guests perused the Black section which received the most damage inflicted by the Creek Land & Cattle Company, It didn’t take very long to realize that the last names on the headstones are the same last names on our neighbors mailboxes today….Rankin, Clark, Herron, Davis, Shaw, Tarrant, Payne, Walker, Carson, Robinson, Williams and so many more. “This is our heritage and this land developer just isn’t concerned about us, but we need to be! Our local officials MUST uphold state cemetery laws, do what is right and be accounted for as well,”+ added Bell as she sat in a lawn chair facing the WEST cemetery long after the rally had ended and the dust had settled along the one road accessing St. Mary Cemetery.

NOTE:
There are two (2) cemeteries—referred to as St. Mary (old) and St. Mary (new). St. Mary Cemetery (old) is located to the WEST which is the black section and St. Mary Cemetery (new) is located to the EAST of Hughes Cemetery Road.

Perhaps, Naomi McKinney, a 3rd grader from Blooming Grove participating in the rally who has ancestors buried at St. Mary Cemetery, said it best, “They need to stop tearing it up….God made this cemetery for us.”

There were more than 70 participants at the SAVE St. Mary Cemetery Rally on Saturday, September 1, 2012. Everybody could see for themselves how the encroachment and desecration of graves by Creek Land & Cattle Company has caused extensive damage, reconfigured the soil and forever altered the landscape at St. Mary Cemetery. Additionally, the new fence they constructed is inside cemetery boundaries on both the north and west sides and the fence sits atop the remains of the dead so that the path of their recently constructed road through the graveyard is not altered. The Ellis County Sheriff’s Office has turned the matter over to the Ellis County District Attorney. We don’t want this matter buried in bureaucracy or otherwise covered up for any reason.

St. Mary Cemetery has been ‘read’ by the Ellis County Genealogical Society at least twice, in 1990 and 2001. Names from headstones recorded during the ‘read’ can be found in Ellis County Historical Records at the Sims Library in Waxahachie. Additionally, cemetery preservationists have been documenting burials at the four (4) cemeteries on Hughes Cemetery Road for as long, or longer.

This list is updated as new information is located through death certificates, obituaries, and family narratives such as Holy Bible or other written data. Family connections from census data and placement of visible headstones are used to estimate location of family plots.
